Five Financial Services Agencies Issue Joint Statement Reaffirming the Role of Supervisory Guidance
Last Tuesday, the Board of Governors of the Federal Reserve System, Bureau of Consumer Financial Protection, Federal Deposit Insurance Corporation, National Credit Union Administration and Office of Comptroller of the Currency issued a joint statement outlining the role of supervisory guidance for regulated institutions.

Unlike a law or regulation, supervisory guidance does not have the force and effect of law and the agencies do not take enforcement actions based on supervisory guidance. Rather, supervisory guidance outlines the agencies' supervisory expectations or priorities and articulates the agencies' general views regarding appropriate practices for a given subject area." MBA has long advocated against enforcement actions based only on regulatory guidance rather than on laws or regulations, as well as regulation through enforcement. Senate Confirms Charles Retting as IRS Commissioner
Last Wednesday the Senate confirmed Charles Retting to be IRS Commissioner by a vote of 64-33. Retting previously served as a partner at the Beverly Hills tax law firm of Hochman, Salkin, Rettig, Toscher & Perez, P.C. Retting arrives at a time where the IRS and Treasury Department is working to release and finalize a number of rules resulting from the Tax Cuts and Jobs Act passed last year, including pending proposed rules on the pass-through deduction.
