    Krista Cooley is a partner in Mayer Brown’s Washington DC office and a member of the Consumer Financial Services group. She concentrates her practice on federal regulatory enforcement and compliance issues. She represents companies in the mortgage lending, mortgage servicing, title insurance and real estate industries in connection with administrative and regulatory compliance matters. Krista defends clients subject to government audits, investigations and enforcement proceedings before, among others, HUD, the VA, USDA, DOJ, CFPB and state banking departments in cases involving the False Claims Act, the Program Fraud Civil Remedies Act, Mortgagee Review Board proceedings and RESPA enforcement matters. She advises clients about federal and state consumer credit and protection laws and regulations, including RESPA, FHA, VA, USDA Rural Housing Service (RHS) and Home Equity Conversion Mortgage (HECM) requirements. Krista reviews and analyzes existing and proposed business arrangements for compliance with federal and state law requirements and drafts related agreements and disclosures. She performs regulatory compliance due diligence, with particular emphasis on FHA-insured origination and servicing requirements.

    Melissa J. Klimkiewicz, Partner, Buckley LLP

    A Partner in Buckley LLP’s Washington, D.C. office, Ms. Klimkiewicz frequently assists FHA mortgagees with their program approval efforts, annual recertification processes, compliance with and understanding of program rules and self-reporting obligations, audits by the Quality Assurance Division, inquiries from HUD’s Office of the Inspector General (HUD OIG), and enforcement actions by the Mortgagee Review Board. She performs similar work related to the U.S. Department of Veterans Affairs (VA), U.S. Department of Agriculture Rural Housing Service (RHS), and Ginnie Mae loan programs.  Ms. Klimkiewicz’s work also includes assisting clients with False Claims Act (FCA)-based risk assessments arising from participation in government lending.  She represents both forward mortgage and reverse mortgage / Home Equity Conversion Mortgage (HECM) lenders and servicers.  Ms. Klimkiewicz also frequently counsels clients in matters arising under the Flood Disaster Protection Act (FDPA), RESPA, TILA, SAFE Act /state licensing laws, and other consumer financial laws impacting lending and servicing.

    For more than 30 years, Cindy has served as regulatory counsel to national and state-chartered banks, mortgage lenders and mortgage servicers.  Cindy joined Freedom Mortgage in 2011  to assume the newly created role of in-house regulatory counsel. She and her team are responsible for providing regulatory support to all of the company’s lines of business through a robust compliance program that includes: regulatory change management, formal compliance policies and procedures,  structured compliance training, compliance monitoring and testing,  consumer complaint analysis and managing regulatory exams. At the direction of Freedom’s CEO, Cindy partnered with the company’s information technology team to embed compliance controls in Freedom’s proprietary loan origination system and, later, in the servicing system of record.  In this way, Freedom’s loan origination and servicing systems contain a comprehensive quality assurance function that is operational at all times. Cindy leads a dedicated team of regulatory counsel and compliance professionals who strive to maintain regulatory compliance throughout the Freedom enterprise.

    Sabrina Rose-Smith, Partner, Goodwin

    Sabrina Rose-Smith is a partner in Goodwin's Financial Industry and Consumer Financial Services Litigation practices. Her nationwide practice includes both defending financial institutions against consumer class actions and government enforcement actions, and regulatory compliance counseling for banks, credit card issuers, mortgage lenders and specialty finance companies. She is the lead editor of LenderLaw Watch. Goodwin's LenderLawWatch blog monitors, chronicles and analyzes news and legal issues affecting clients and others in the consumer finance industry.  Ms. Rose-Smith defends her financial services clients in cases involving the Truth In Lending Act (TILA), the Fair Debt Collection Practices Act (FDCPA), the Real Estate Settlement Procedures Act (RESPA), the Fair Housing Act (FHA), the Equal Credit Opportunity Act (ECOA), the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (FIRREA), the Telephone Consumer Protection Act (TCPA), state and federal unfair and deceptive trade practices (UDAP) statutes and other alleged violations of law arising from her clients’ lending, servicing and/or collections activity.
