    Mortgage servicing compliance continues to be a significant challenge with on-going developments. This session takes a closer look at recent issues of particular importance to servicers. Experts discuss LEP and other state law trends, the CFPB’s proposed debt collection rules, and other major developments.

    Tobias regularly counsels lenders, servicers, investors, and settlement service providers with regard to compliance with various federal statutes and regulations including RESPA/Regulation X, TILA/Regulation Z, ECOA/Regulation B, HMDA/Regulation C, and UDAAP.  Tobias also advises clients with regard to compliance with state lending and servicing statutes and regulations. He has  experience preparing 50 state surveys summarizing licensing requirements, advertising restrictions, disclosure obligations, permissible fees and charges, record retention requirements, telemarketing, usury limits, and foreclosure considerations. Tobias assists clients with complying with the seller/servicer requirements set forth by Fannie Mae and Freddie Mac and the requirements set by insurers such as the Federal Housing Administration and the U.S. Department of Veterans Affairs.

    Samuel I. Racoosin, Managing Director and Associate General Counsel, JP Morgan Chase Bank, NA

    Samuel Racoosin is a Managing Director and Associate General Counsel at JP Morgan Chase Bank, NA.  He is the lead attorney for the residential Loan Servicing performing, customer assistance and default legal teams.  He is principally responsible for providing legal advice to the residential mortgage loan servicing business.  Before joining JP Morgan Chase, Racoosin was Associate General Counsel at Fannie Mae.  In that capacity, he was responsible for providing legal advice to the US Treasury in connection with the Obama Administration’s Making Home Affordable Program.  Samuel previously served as Associate General Counsel for Fannie Mae’s single-family mortgage business, providing advice on new products, eMortgage initiatives, and loss mitigation.  Prior to joining Fannie Mae, Samuel was Associate General Counsel of North American Mortgage Company, a national mortgage banker.

     

    Reid F. Herlihy, Partner, Ballard Spahr LLP

    Reid F. Herlihy provides regulatory and transactional advice for clients on a range of issues involving state and federal consumer finance laws. Reid counsels mortgage companies, servicers, consumer finance companies, financial institutions, investment banks, debt collectors, and secondary-market investors on state and federal regulatory compliance issues.  Reid regularly counsels clients on issues regarding the CFPB's Mortgage Servicing Rules, advertising, fair debt collection, lending and servicing disclosures, loss mitigation, foreclosure procedures, and business practices. He also assists clients with state and federal examination issues and regulatory actions.  Reid assists clients with meeting state and federal licensing and approval requirements, including those related to stock and asset acquisitions. He has extensive experience with the SAFE Act and has counseled numerous mortgage companies, servicers, and third-party service providers on implementing those requirements.
