    Kim Phan counsels financial institutions on privacy and data security law in areas including the GLBA, FCRA, TCPA, and other federal and state privacy and data security statutes and regulations. Her work in this area encompasses strategic planning and guidance for companies to incorporate privacy and data security considerations throughout product development, marketing, and implementation. She also assists companies with data breach prevention and response, including establishing effective data security programs prior to a breach and the assessment of breach response obligations following a breach.  Kim also assists clients with regulatory compliance matters, including supervisory and enforcement interactions with the CFPB, FTC, other federal regulatory agencies, and state attorneys general and departments of consumer protection investigations.  Kim also provides extensive e-commerce and mobile counseling, including adapting business strategies to the mobile environment, conducting online behavioral advertising assessments of websites, enhancing website privacy policies, and social media employee training programs.

    Joseph T. Lynyak, III, Partner, Dorsey & Whitney LLP

    Joe Lynyak is a long-time adviser to the financial services industry, with a depth of experience that allows him to “connect the dots” for clients in the complex (and sometimes conflicting) regulatory and statutory schemes confronting financial intermediaries.  A partner in Dorsey & Whitney’s Finance & Restructuring Group and a member of the firm’s Banking Industry Group, Joe possesses a broad knowledge base regarding foreign banks and domestic banks, savings associations, bank holding companies, finance companies, mortgage banking companies and their subsidiaries and affiliates. His practice includes providing financial intermediaries advice in the areas of regulatory and strategic planning, application and licensing, legislative strategy, commercial and consumer lending, examination, supervision and enforcement, and general corporate matters.  pJoe’s FDIC-insured financial institution clients benefit from his experience in the special state and federal statutory and regulatory requirements—including safety and soundness issues—that apply to regulated financial intermediaries. He regularly counsels clients on matters such as retail operations, privacy, identity theft, consumer compliance, application and underwriting, payments systems, Internet, electronic commerce, examination, supervision and enforcement, and operational and strategic planning matters.

    Sheraz Syed, Regulatory Associate, Mortgage Bankers Association

    Sheraz Syed is an attorney in Residential Policy at the Mortgage Bankers Association. As part of the Regulatory Policy team he focuses on policy development, research, analysis, and member outreach on matters related to financial technology, innovation, fraud issues, and data protection. As a subject-matter expert on information privacy, he leads policy development on consumer data privacy and cybersecurity. Prior to entering the mortgage finance industry he spent time as a litigator representing financial institutions, debt collection agencies, and commercial real estate companies. 

    Aaron Brown, Associate General Counsel, Mr. Cooper

    Aaron Brown has spent the last 12 years in the mortgage industry spanning various roles in operations, legal and compliance. Over the past five years, he has worked in different areas within Mr. Cooper with a specific focus on regulatory compliance in the consumer finance context. He regularly advises business partners on federal requirements under RESPA, ESIGN, TCPA, GLBA, FCRA, TILA, and ECOA. He first began supporting privacy-related initiatives in 2015 in connection with the launch of a mobile app dedicated to MLS real estate searches. Aaron is also working to enhance Mr. Cooper’s privacy program while supporting Mr. Cooper’s information security and originations teams. Lately, devising and analyzing implementation strategies for the upcoming California Consumer Privacy Act takes up most of his time. In 2016, Aaron obtained his CIPP/US.
