A servicing agreement is a contract between a lender/investor and a servicer that stipulates various obligations and requirements of the servicer. Servicing agreements exist in a variety of formats, lengths, and levels of detail. Although most servicing agreements address the same core servicer activities, the requirements and conditions that the servicer must adhere to may vary, particularly depending on the type of transaction (CMBS, GSEs and agency, or portfolio).

Commercial/Multifamily Servicing Agreement Fundamentals explores the basic concepts of various servicing agreements across CMBS, GSEs and agency, and portfolio lending transactions. First, it discusses the basic characteristics and types of commercial/multifamily mortgage loan servicing agreements. Next, it explores how servicing agreements typically cover servicer-initiated activities, such as payment collection, escrows, etc. It then covers the manner in which servicing agreements address typical borrower requests. Finally, it talks about the transferability of servicing agreements in servicing transfer situations.
